Terms of Service
The agreement between you and Crackers Mart when you subscribe to a storefront. Please read the section on licences — it explains what we are and are not responsible for.
Last updated 20 September 2026
1. Who you are agreeing with
Crackers Mart is a product of Pay Vasool, a micro enterprise registered under Udyam in India (“we”, “us”). Crackers Mart is our brand name; the business you are contracting with, and that appears on your payment receipts, is Pay Vasool (Udyam Registration Number UDYAM-AP-21-0039334). These terms apply whenever you create an account, subscribe to a plan, or use anything at crackersmart.shop.
If you do not agree with them, do not use the service. If you subscribe on behalf of a shop, you confirm you are authorised to bind that shop to these terms.
2. What the service actually is
We sell software by annual subscription, and nothing else. Your subscription gives you a hosted storefront website for your shop, a dashboard to manage your products, customers, enquiries and instalment plans, and a choice of designs and colours.
We do not sell fireworks, and we never handle your customers’ money. Shoppers browse the storefront you publish and send you an order enquiry over WhatsApp. Every sale, price, payment and delivery is settled between you and your customer directly, offline. We are not a party to it, we take no commission on it, and no goods are ever transacted through us.
3. Licences, safety and lawful goods — your responsibility
Fireworks are regulated in India under the Explosives Act, 1884 and the Explosives Rules, 2008, and further restricted by state rules and by orders of the Supreme Court and the National Green Tribunal on permitted compositions, sale periods and bursting hours.
You are solely responsible for holding every licence and permission your business requires, for listing only goods you may lawfully sell, and for obeying all restrictions that apply to your storage, sale and delivery. We provide a website. We do not verify your licences, inspect your stock, or take any part in your sales.
Listing prohibited goods — or goods you are not licensed to sell — is a breach of these terms and we may suspend your shop immediately under section 8.
4. Your account
Give us accurate details and keep them current. You are responsible for everything done through your account and any staff accounts you create, and for keeping passwords and one-time codes to yourself. Tell us promptly if you believe someone else has access.
5. Your content, and your customers' information
Your shop name, logo, product photos, descriptions and prices remain yours. You give us permission to host and display them for the purpose of running your storefront. You confirm you have the right to use every image and name you upload.
Information about your customers — names, phone numbers, addresses, order history, instalment records — belongs to you and you decide what happens to it. We hold and process it on your instructions so the service can work. Our Privacy Policy explains how.
6. Fees and renewal
Plans are billed as a single yearly amount, shown inclusive of applicable taxes at the time you pay. Your subscription runs for one year from the date payment is confirmed.
There is no automatic renewal and no stored mandate. We never debit you without you starting the payment yourself. When your year is ending we will tell you in the dashboard, and it is entirely your choice whether to renew. If you do not, the shop simply stops at the end of the term.
Refunds are governed by our Refund & Cancellation Policy.
7. What you may not do
Do not use the service to break the law, to list goods you cannot lawfully sell, to impersonate another shop, to upload someone else’s photographs or trademarks without permission, to send unsolicited bulk messages, or to attack, probe or overload the platform. Do not resell or relicense the software itself.
8. Suspension and ending the agreement
You may stop using the service at any time; see the refund policy for what that means financially. We may suspend or close an account that breaches these terms, that is being used unlawfully, or where non-payment has left the subscription expired.
Where the circumstances allow it we will warn you first and give you a chance to put things right. For serious or unlawful use we may act immediately. If we close your account, you may ask us for an export of your shop and customer data within 30 days.
9. Availability
We work to keep the service running and reasonably quick, but we do not promise it will be uninterrupted or error-free. We may need to take it down for maintenance, and we depend on third parties for hosting, email and payments whose failures are outside our control.
10. Liability
The service is provided as-is. To the extent the law allows, we are not liable for lost profits, lost sales, lost or corrupted data, or any indirect or consequential loss.
Where we are found liable despite the above, our total liability for all claims in any twelve-month period is limited to the subscription fees you actually paid us in that period. Nothing here limits liability that cannot be limited by law.
11. Changes to these terms
We may update these terms as the service changes. If a change materially affects your rights we will give you notice in the dashboard or by email before it takes effect. The date at the top of this page always shows the current version. Continuing to use the service after a change means you accept it.
12. Governing law
These terms are governed by the laws of India, and the courts at Chirala, Andhra Pradesh have exclusive jurisdiction over any dispute arising from them.
13. Contact
Questions about these terms go to [email protected], or through our contact page.
